Employment of Expatriates in Malaysia (Part 1 : Overview)

Malaysia’s globalised economy has facilitated growth and development through the years. As an open economy, Malaysia takes national competitiveness seriously in efforts to continue to attract foreign direct investments, sustain domestic investments and maintaining position in the global trading environment.

The Malaysian Government sees private sector as the main driving force of economic growth and development in the country, while the Government itself takes on the role of facilitating business. As such, efforts have been made to continuously improve the Government’s delivery system and to enhance the cost-effectiveness of doing business in Malaysia.

With globalisation, capital, goods, ideas, and people move increasingly freely across a borderless world. As such, although placing great emphasis on the development of the country’s own human capital, the Malaysian government has always welcomed foreign talents, recognising the fact that Malaysian workers would benefit from this interaction. These talents will invariably add value to the work force. It is hoped that the information provided will be a useful reference tool for Malaysian-owned and foreign-owned companies operating in or planning to set up business in this country.

Employment of Expatriates

There are two stages in the employment of expatriates: Application for an expatriate post and an
endorsement of employment pass.

Stage 1: Application for Expatriate Post
This is the stage where a company submits its application for expatriate posts. The Government has appointed the following agencies to evaluate and approve expatriate posts.

  • Malaysian Industrial Development Authority (MIDA) for the manufacturing and its related services sectors.
  • Multimedia Development Corporation (MDeC) for the information technology sector, specifically companies that have been awarded Multimedia Super Corridor (MSC) Status.
  • Central Bank of Malaysia (BNM) for the financial, insurance and banking sectors.
  • Securities Commission (SC) for the securities and futures market.
  • Public Service Department (PSD) for contract of employment in Public Sector.
  • Expatriate Committee (EC) for expatriate posts in sectors other than the above mentioned sectors. The Employment Pass Division of the Immigration Department of Malaysia is the secretariat for EC.

Stage 2: Endorsement of Employment Pass
Upon approval of the expatriate posts by the approving agency, the company must submit an application to the Immigration Department for endorsement of the Employment Pass. The endorsement of related passes can be made at Employment Pass Division, Immigration Department of Malaysia or the nearest State Immigration office. Once the Employment Pass has been endorsed, the expatriate can be hired.

Issuance of employment pass or passes related to expatriate posts is solely under the jurisdiction of the Immigration Department.

Types of Expatriate Posts
Applicants can apply for the following expatriate posts:

1. Key Posts
These are high level (1st level) managerial posts in foreign-owned private companies and firms operating in Malaysia. Key posts are posts essential for companies to safeguard their interests and investments. The expatriates are responsible in determining the company’s policies in achieving its goals and objectives.

Example: Executive Chairman, Chief Executive Officer, Managing Director, General Manager, Technical Director, Production Manager, Project Manager or Factory Manager.

2. Executive Posts
These are intermediate level (2nd level) managerial and professional posts. The posts require academic qualifications, practical experience, skills and expertise related to the respective jobs. The expatriates are responsible for implementing the company’s policies and supervision of staff.

Example: Management functions such as Marketing Manager, Logistics Manager, Investment Manager and Quality Control Manager. Professional such as Chief Engineer, Engineering Manager, Lecturer, Doctor, Architect etc.

3. Non-Executive Posts
These are posts for the performance of technical jobs that require specific technical or practical skills and experience.

Example: Welder, Mould Maker, Mould Designer, Tool & Die Maker, Manufacturing Systems Designer, Food/Nutrient Technologist, Fashion Designer, Specialist in Furniture Design & Ergonomics, Heat Setting Technician, Sewing Specialist, Craftsman/Engraving and Product/Flavouring Specialist.

Minimum Salary & Paid-Up Share Capital Requirements

  • Minimum salary of RM5,000.00 per month and at least 2 years’ employment contract.
  • Minimum equity structure for qualification of an expatriate position is as follows:-

1.  100% Local Owned (Malaysian) – RM 250,000.00
2.  Local & Foreign Joint Ownership – RM 350,000.00
     (If WRT License is required, the minimum paid-up share capital is RM 500,000.00)*
3.  100% Foreign Owned – RM 500,000.00 
     (If WRT License is required, the minimum paid-up share capital is RM1 million)*

* What is WRT and why is it required?

WRT stands for Warehousing, Retail & Distributive Trade. Under the policy on foreign participation in wholesale and retail trade, all proposals for foreign involvement must be granted approval by the Committee on Wholesale and Retail Trade (CWRT). This includes the opening of new branches and relocation.

Objectives of the policy are:

• to ensure a fair and orderly development of the industry, including the interest of local traders;
• to streamline the industry with the national objective of increasing Bumiputera (indigenous people) participation in the economic sector, in line with the National Development Policy; and
• to encourage modernisation and to increase efficiency of the industry and its continued contribution to the growth of the economy.

Important :-  Expatriate/Employment Pass (EP) is not guaranteed by amount of investment but by justification of the need for the applicant’s skill.

MM2H Post Conditional Approval – Purchase Medical Insurance

Malaysia My Second Home (MM2H) is a programme inaugurated by the Malaysian government under the jurisdiction of Ministry of Tourism. It is an aspiring option for those who wish to retire or set up a second home in the country for as long as possible on a multiple entry social visit pass.

The MM2H programme is open to citizens of all countries recognized by Malaysia, regardless of race, religion, gender or age. The programme permits applicants to bring along their spouse, unmarried children below the age of 21 and parents above the age of 60 as dependants. Foreign spouses of Malaysians and expatriates who wish to retire in Malaysia after expiry of their Employment Passes are also eligible to apply for stay in Malaysia on this programme.

Upon successful application, participants will be granted a 10-year Social Visit Pass with a Multiple Entry Visa, subject to the validity of their passport, and is renewable.

Applicant is required to plan a trip to Malaysia for 3 working days within 6 months from the date of Conditional Approval.

The following is one of three landing procedures that must then be completed before endorsement of the MM2H Visa :-

Purchase Medical Insurance

  • Approved applicants and their dependants must possess valid medical insurance coverage that is applicable in Malaysia from any insurance company.
  • Exemptions may be given for participants who face difficulty in obtaining a medical insurance due to age factor or result of medical condition.

Conditional Renewal
This Policy will be renewable subject to the terms and conditions at each of the anniversary of the Policy date. The renewal premiums payable is not guaranteed and the Company reserves the right to revise the premium rate applicable at the time of renewal. Such changes, if any shall be applicable to all Policyholders irrespective of their claim experience according to the Company’s risk assessment.

Conditional Renewal will be applicable after two (2) years of Policy inception provided that there is no claim incurred in the previous two (2) years. Subsequently, if there are claims incurred in the later years, the Company will not impose any exclusion upon the Insured Person. If there are claims incurred within the first two (2) years of Policy inception, the Insured Person would still qualify for the renewal, subject to exclusions or premium increase.

The Insured Person shall give immediate notice in writing to the Company on any Injury, Disease, physical defect or infirmity of which the Insured Person has become aware or been affected within the first two (2) years of Policy inception.

This is a yearly renewable Policy. Premium rates are not guaranteed and any adjustment of premiums would be based on satisfactory health condition. Should there be a situation of non-disclosure, the whole Policy would be rendered null and void.

Premiums
Premiums would be based on age band. The minimum age entry is thirty (30) days and the maximum age is sixty-nine (69) years based on age next birthday.

Specified Illnesses shall mean the following disabilities and its related complications, occurring within the first one hundred and twenty (120) days of Insurance of the Insured Person:

(a) Hypertension, diabetes mellitus and cardiovascular disease;
(b) All tumours, cancers, cysts, nodules, polyps, stones in the urinary system and biliary system;
(c) All ear, nose (including sinuses) and throat conditions;
(d) Hernias, haemorrhoids, fistulae, hydrocele, varicocele;
(e) Endometriosis including disease of the reproduction system;
(f) Vertebro-spinal disorders (including disc) and knee conditions.


Note:
1. There will be a waiting period of thirty (30) days from the commencement date of insurance for sickness benefits. No benefits will be payable if hospitalization and/or illness commences within this period. Coverage for accidental bodily injuries will, however, be effective upon the commencement of insurance.
2. Application for change of benefits to a higher plan can only be made on Policy Anniversary Date and is subject to acceptance by the Company.
3. If you are not satisfied with this Policy for whatever reason, you may return it to us within fifteen (15) days from the date of delivery. We will cancel the Policy and refund to you all premiums paid provided there was no medical expenses incurred.
4. This Policy is renewable at the option of Policyholder until the occurrence of any of the following:
(a) Non payment of premium or premium not paid on time;
(b) Fraud or misrepresentation of material fact during application;
(c) The Policy is cancelled at the request of the Policyholder;
(d) Total claims of the Policy have reached the lifetime limit specified and/or on the death of the Insured Person;
(e) The Insured Person attains the coverage age limit specified;
(f) Termination of coverage for all policies in a certain market and the Company withdraws this Policy completely from the market in accordance with the Portfolio Withdrawal Condition.

Purchasing a Property – What You Need To Know – Legal Fees

Buying a house could be the largest single investment you will ever make, but one may be entering into it with little or no experience on real estate or mortgage finance.

Unfortunately, it is not as simple as obtain a mortgage, grab the keys and bish bash bosh, you’re in. Purchasing a property is almost guaranteed to cost more than you think.

The main inherent costs are legal fees, mortgage arrangement fees, stamp duty and valuation fees. Make sure you keep some cash aside from your deposit to cover them.

There are instances when ill informed purchasers failed to allocate funds for the completion of property transactions, thus resulting in forfeiture of deposits paid. The importance of proper financial planning is paramount to avoid such losses.

Visa Procedures & Malaysian Permit

New Application

Documents required from International Student to be submitted to the school:

  • Student’s original passport (note: passport must be valid for the next 30 months to apply for student visa).
  • A copy of student’s passport detail page which includes current passport expiry date.
  • A copy of student’s current visa.
  • Photocopy of student’s birth certificate (translated to English).
  • Student’s passport size photograph (4 pieces colour photo).
  • Photocopy of father’s passport detail page only.
  • Photocopy of mother’s passport detail page only.
  • Leaving certificates from previous school (for transfer pass only).

Upon receiving all the documents, the school will submit the Student Visa Application to Malaysian Immigration State Department.

Estimated time to process for approval is 4 weeks.

 

Renewal of Student Visa

In most cases, Malaysia Immigration only releases Student Visa Endorsement, which is valid for 1 year.

International students are required to renew the Student Visa Endorsement every year.

The students are advised to renew the student visa one month before the expiry date.

 

Malaysia Permit Application Procedures

As for Malaysian students admitting to Fairview International School, you need to apply for Malaysian Permit from the Ministry of Education, Malaysia.

Documents needed:

  • Application form for Admission for Malaysian student to enter Expatriate School.
  • Photocopy of student’s birth certificate.
  • Student’s passport size photograph (2 pieces colour photo).
  • Photocopy of father’s and mother’s identity card.
  • Leaving certificates from previous school.
  • Supporting letter from parent’s employment.

World-renowned Langkawi beckons with sun-kissed beaches, clear blue skies and the marvels of nature.

Langkawi is the largest of a multitude of islands that lie off the coast of Kedah state, in the far northwest of Peninsular Malaysia. The island comprises a jeweled setting of 99 islands. Langkawi is a versatile holiday destination with world-class infrastructure and facilities – a modern international airport, excellent roads, state of the art marinas, budget hotels to award-winning luxurious resorts, superb golf courses and a host of recreational activities.

Visitors arriving by sea will disembark at the jetty in the main town of Kuah. Located southeast of the island, the town houses many hotels and shopping centres. A large prominent statue of an eagle, situated at the popular Eagle Square is visible from afar when approaching the island. According to local folklore, Langkawi derived its name from the eagle or helang.

Langkawi’s idyllic beaches are perfect settings for a fun-filled vacation. Tanjung Rhu Beach, 22 km north of Kuah, is fringed by casuarinas from which the beach gets its name. A perfect place for picnic, this wide sandy beach offers unmatched pristine tranquility. The sunset here at dusk, in a blaze of orange and red is truly a spectacular sight.

 

On the western coastline of Langkawi, lie the beaches of Datai, Kok, Burau Bay and Tengah. Enjoy a round of golf at the 18-hole course at Datai Bay and tee off against Langkawi’s scenic backdrop. Those who wish to spend their day at Burau Bay can enjoy horseback riding while visitors to Tengah Beach can hire a boat and go island hopping. Kok Beach is the location of Telaga Harbour Park, a marina-cum-resort with ample facilities.

Cenang Beach is only 3 km from the Langkawi International Airport and is the most developed of the beach areas housing several luxury class hotels and dozens of budget chalets and restaurants. There are plenty of water sports available on this popular beach providing fun and excitement for all.

First-class accommodation in modern hotels or comfortable chalets is available around the island. Restaurant outlets in the hotels and outdoors serve a variety of local and international fare with live music and an energetic ambience.

Go snorkeling and diving in the Payar Island Marine Park, 19 nautical miles south of Langkawi. Segantang Island, Kaca Island and Lembu Island are other islands that make up the Marine Park. For those shy of the sea, hop into a glass-bottomed boat and watch the underwater world unfurl below. Speedboats or catamarans shuttle visitors from Langkawi to the Marine Park within an hour.

Langkawi offers a back-to-nature experience for all. From waterfalls to mysterious caves, visitors will discover that Langkawi is more than a beach lovers’ paradise.

There are a host of themed attractions in Langkawi providing excitement for young and old travelers alike. Come and discover the variety of aquatic life at the Underwater World Langkawi. This largest public aquarium in the country features stingrays, sharks, moray eels and green turtles together with exotic fishes and sea plants.

There are also interesting handicraft centres and souvenir shop located around the island offering items such as batik outfits and silverware. Cultural performances and batik workshops can be enjoyed at these centres.

Those who wish to be pampered with a relaxing massage amidst the lush backdrop of the rainforest, can head to the numerous spas on the island.

With an attractive range of duty-free goods to choose from in Langkawi, shopping here is a real treat. From pewter and perfumes to liquor and leather, the attractive prices make shopping irresistible!

Getting There :

By Road

Visitors traveling by road will have to drive to Kuala Kedah or Kuala Perlis, the main jumping-off points by ferry to Langkawi. Regular, air-conditioned buses are also available from Kuala Lumpur to Kuala Kedah and Kuala Perlis. The journey to Kuala Kedah takes about six hours while Kuala Perlis is another hour away.

By Air

Malaysia Airlines provides direct air services from the Kuala Lumpur International Airport (KLIA) to Langkawi. Alternatively, visitors can take the budget carrier AirAsia or Firefly. AirAsia operates from the Low Cost Carrier Terminal (LCCT) in Sepang while Firefly operates from the Sultan Abdul Aziz Shah Airport in Subang.

By Rail

Keretapi Tanah Melayu (KTM) or Malayan Railway provides economical and comfortable rail services from Kuala Lumpur to Alor Setar in Kedah and Arau in Perlis. From these points, take a taxi or bus to Kuala Kedah and Kuala Perlis for your ferry to Langkawi.

By Sea

Express ferries provide regular services daily to Langkawi from both Kuala Kedah and Kuala Perlis. The journey takes about 1 hour 15 minutes and 45 minutes respectively. From Penang to Langkawi the ferry takes 2 hours 30 minutes. The island is also a stopover for Star Cruises, one of the largest luxury cruise lines in the world.
